Summary. MyFlySim is a prepaid mobile connectivity solution provided by the company MyFlySim, by means of an eSIM card or profile. The service provides Internet access abroad from a compatible device. The offer has no fixed-term commitment; however, once purchased, no top-up or plan can be refunded except in the cases provided for by law.
MyFlySim, a company incorporated under French law, provides the service and manages data in accordance with applicable legislation, in particular the French Consumer Code and the GDPR.
1. Definitions and scope of the contract
The "Service" means the Internet access provided by MyFlySim through the purchase of a data plan on an eSIM-compatible device. The Service is purchased and managed via the official website www.myflysim.com.
These General Terms (hereinafter the "GT") govern the contractual relationship between MyFlySim and you (the "Customer"). By using the Service, you unreservedly accept these GT.

3. Eligibility
Use of the Service is reserved for adults. Minors must have the consent of a legal representative. Upon activation, MyFlySim may request an identity document, in accordance with French legislation on the identification of users of electronic communications services.
4. Description and operation of the service
The Service operates through mobile connectivity provided by third-party operators with which MyFlySim has agreements. The Service includes neither voice calls nor SMS. You must have an eSIM-compatible, unlocked device, whose compatibility you have verified yourself before purchase.
5. MyFlySim's commitments
MyFlySim undertakes to provide a service that complies with its description at the time of purchase. However, the quality of the service may depend on technical factors beyond its control (third-party networks, geographical conditions, interference, etc.). MyFlySim provides customer support in the event of a problem.
6. Customer's obligations
You undertake to:
- use the eSIM card only on the intended device,
- refrain from using the service for fraudulent purposes or purposes contrary to public order,
- inform MyFlySim of any loss, theft or suspicious use of the eSIM card,
- keep your data up to date.
MyFlySim may suspend or terminate the service in the event of misuse, non-compliance with the GT, or prolonged inactivity (18 months without use).
7. Prices, top-ups and validity
Plans are prepaid, non-transferable, and valid only on compatible devices. No refund can be issued once the eSIM has been activated, except in the event of a technical defect attributable to MyFlySim or where a right of withdrawal applies under the French Consumer Code.
An eSIM that you have disabled and then deleted from your device is deemed abandoned. After a period of one (1) month from its deletion, it is no longer allocated to you and may be returned to stock by MyFlySim for reallocation; any subsequent use will require a new order.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of services that have been fully performed before the end of the withdrawal period, where performance began with the consumer's prior express consent and express waiver of their right of withdrawal. Accordingly, by activating the eSIM card on your device, you expressly consent to the performance of the service beginning immediately and acknowledge that you thereby lose your right of withdrawal.
8. Refund policy
A refund is possible only if:
- The QR code has not yet been scanned.
- A proven technical defect prevents use of the service.
Any request must be submitted within 14 working days together with proof of payment. No refund is possible for a locked device where this is stated on the product page.
9. Suspension or disconnection
MyFlySim may suspend the service temporarily or permanently:
- for maintenance,
- in the event of fraud or abnormal use,
- where required by the authorities,
- for prolonged inactivity or non-compliance with the law.
10. Limitation of liability
MyFlySim is not liable for interruptions caused by third-party networks or by events of force majeure. Liability is limited to the amount paid by the customer in the month preceding the dispute, except in cases of gross negligence or wilful misconduct.
In the event of incorrect installation of the eSIM, MyFlySim may under no circumstances be held liable for out-of-plan charges caused by incorrect configuration or misuse on the part of the Customer, in particular roaming charges billed by the operator of their main line. It is the Customer's responsibility to check the configuration of their device before and during their trip (selection of the data line, activation of data roaming on the MyFlySim eSIM, deactivation of mobile data and roaming on their main line).
11. Personal data
Data collected by MyFlySim is processed in accordance with the GDPR. You have rights of access, rectification, erasure and objection. Any request must be sent to contact@myflysim.com.
12. Intellectual property
The trademarks, logos and trade names related to MyFlySim are protected. You are not authorised to use them without written authorisation.
13. Assignment of the contract
MyFlySim may transfer its rights to a third party. The customer may not assign the contract without prior written consent.
14. Governing law and jurisdiction
These GT are governed by French law. Any dispute shall fall within the exclusive jurisdiction of the courts of Paris, unless mandatory legal provisions provide otherwise.
15. Force majeure
MyFlySim cannot be held liable in the event of circumstances beyond its control making performance of the contract impossible.
16. Final provisions
If any provision of these GT is declared invalid, the remaining provisions shall remain fully applicable. This document constitutes the entire agreement between MyFlySim and the Customer.
