TERMS AND CONDITIONS OF SALE & USE – MYFLYSIM

Summary

MyFlySim is a prepaid mobile connectivity solution provided by DIRLAND via a physical SIM card or an eSIM profile. The service allows access to the Internet internationally from a compatible device. The offer has no minimum duration commitment, but once purchased, any top-up or plan cannot be refunded except as provided by law.

DIRLAND, a French company, ensures the service and data management in accordance with applicable laws, including the French Consumer Code and GDPR.

  1. Definitions and Contract Framework

    The “Service” refers to Internet access provided by DIRLAND through the purchase of a data plan on a compatible eSIM device. The purchase and management of the service are conducted via the official website www.myflysim.com.

    These Terms and Conditions (hereinafter “T&Cs”) govern the contractual relationship between DIRLAND and you (the “Customer”). By using the service, you unconditionally accept these T&Cs.

  3. Eligibility

    The Service is reserved for adults. Minors must have the consent of a legal guardian. During activation, DIRLAND may request an identity document in accordance with French law regarding identification of electronic communications service users.

  4. Service Description and Operation

    The Service operates through mobile connectivity provided by third-party operators with whom DIRLAND has agreements. The service does not include voice calls or SMS. You must have a compatible, unlocked eSIM device, and verify compatibility before purchase.

  5. DIRLAND’s Commitments

    DIRLAND commits to providing a service in accordance with the description at the time of purchase. However, service quality may depend on technical factors beyond its control (third-party networks, geographic conditions, interference, etc.). DIRLAND provides customer support in case of issues.

  6. Customer Obligations
    • Use the eSIM only on the intended device.
    • Do not use the service for fraudulent purposes or against public order.
    • Inform DIRLAND of any loss, theft, or suspicious use of the eSIM.
    • Keep your data up to date.

    DIRLAND may suspend or terminate the service in case of abuse, non-compliance with the T&Cs, or prolonged inactivity (18 months without use).

  7. Prices, Top-Ups, and Validity

    Plans are prepaid, non-transferable, and valid only on compatible devices. No refund can be made once the eSIM is activated, except in case of a technical defect attributable to DIRLAND or the right of withdrawal applicable under the French Consumer Code.

    According to Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of services fully performed before the end of the withdrawal period, where execution began with the consumer’s prior express consent and their express waiver of the right of withdrawal. By activating the eSIM on your device, you expressly consent to immediate service execution and acknowledge losing your right of withdrawal.

  8. Refund Policy
    • The QR code has not yet been scanned.
    • A proven technical defect prevents the use of the service.

    All requests must be submitted within 14 working days with proof of payment. No refund is possible for a locked device if stated on the product page.

  9. Suspension or Disconnection
    • For maintenance.
    • In case of fraud or abnormal use.
    • If required by authorities.
    • Due to prolonged inactivity or legal non-compliance.
  10. Limitation of Liability

    DIRLAND is not responsible for interruptions caused by third-party networks or force majeure events. Liability is limited to the amount paid by the customer in the month preceding the dispute, except in cases of gross negligence or intentional fault.

  11. Personal Data

    Data collected by DIRLAND is processed in accordance with GDPR. You have the right to access, rectify, delete, and object to your data. All requests should be sent to contact@myflysim.com.

  12. Intellectual Property

    Trademarks, logos, and trade names related to DIRLAND or MyFlySim are protected. You are not authorized to use them without written permission.

  13. Assignment of Contract

    DIRLAND may transfer its rights to a third party. The customer may not assign the contract without prior written agreement.

  14. Governing Law and Jurisdiction

    These T&Cs are governed by French law. Any dispute will fall under the exclusive jurisdiction of the courts of Paris, except for mandatory legal provisions to the contrary.

  15. Force Majeure

    DIRLAND cannot be held liable for events beyond its control that make contract execution impossible.

  16. Final Provisions

    If any provision of these T&Cs is declared invalid, the remaining provisions remain fully applicable. This document constitutes the entire agreement between DIRLAND and the Customer.
